These Terms and Conditions of Use (“Terms”) govern your access to and use of the Total Wealth Management App (“App”), which is published and maintained by Community Financial Services Group, LLC (“CFSG,” “we,” “our,” or “us”), a Vermont-based wealth management firm.
The App is developed by SEI Investments Company (“SEI”) under agreement with CFSG. SEI provides technology and data services but does not provide financial advice or enter into a direct relationship with you.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App. CFSG may modify these Terms at any time, with updates posted within the App and on our website. Continued use signifies acceptance of the revised Terms.
Authorized Use
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely to access your CFSG account(s) and related services for your personal, lawful, non-commercial use.
CFSG may suspend or terminate access at any time for security, compliance, or misuse concerns.
No Investment Advice
The App provides access to account information, balances, performance summaries, and related data for convenience. The App does not provide investment advice or recommendations, and nothing within the App should be construed as an offer or solicitation to buy or sell securities.
All investment decisions should be based on official statements and discussions with your CFSG advisor.
Data Privacy and Security
Use of the App is governed by CFSG’s Privacy Policy, available at Privacy Policy.
By using the App, you consent to CFSG’s collection, use, and disclosure of personal information as described therein.
CFSG and SEI maintain administrative, technical, and physical safeguards consistent with federal and Vermont law to protect your data.
In the event of a security breach involving your nonpublic personal information, CFSG will provide notice as required by Vermont law.
Account Access and Responsibilities
You are responsible for maintaining the confidentiality of your credentials and any device security controls (PIN, biometric, passcode).
You agree to:
- Immediately notify CFSG if you suspect unauthorized access.
- Secure your mobile device to prevent unauthorized use.
- Assume responsibility for all actions taken through your credentials.
CFSG and SEI are not liable for losses resulting from your failure to protect your login credentials or device.
Third-Party Links and Held-Away Accounts
The App may display data from other financial accounts you link (“held-away accounts”) or link to third-party services.
CFSG and SEI do not control, verify, or endorse third-party information and are not responsible for errors, timeliness, or accuracy of such data.
You assume full responsibility for your use of third-party data and services.
Intellectual Property
All content, trademarks, software, and data within the App are the property of CFSG, SEI, or their licensors. You may not copy, modify, reverse-engineer, or distribute any part of the App without prior written authorization.
No Warranty
The App and all related services are provided “AS IS” and “AS AVAILABLE.” CFSG and SEI make no warranties, express or implied, regarding functionality, accuracy, reliability, or availability.
You acknowledge that technical errors, interruptions, or data delays may occur.
Limitation of Liability
To the fullest extent permitted by law, CFSG, SEI, and their affiliates, officers, and employees are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the App.
Your sole remedy for dissatisfaction is to discontinue use.
In no event shall CFSG’s or SEI’s total liability exceed the amount paid by you, if any, for accessing the App.
Updates, Maintenance, and Termination
CFSG or SEI may modify, suspend, or discontinue any part of the App without notice.
We may also require updates or new versions to maintain compliance or functionality.
Your access may be terminated at any time for any reason.
Regulatory Compliance
CFSG is regulated by the Vermont Department of Financial Regulation and complies with applicable federal and state laws governing financial institutions, privacy, and cybersecurity.
Nothing in these Terms limits CFSG’s ability to comply with regulatory or legal obligations.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Vermont.
Any disputes shall be resolved in state or federal courts located in Vermont.
